United Airlines Council 06 EWR

After consultation with the U.S. Department of Labor (DOL), AFA has decided to voluntarily rerun the Council 6 election. A few members of the Council lodged complaints with AFA following the election. AFA conducted an investigation of the complaints and found no violation of our Constitution or election procedures. The complaints then went to the DOL. The DOL advised that we should include in the nomination process an ability for any member to be nominated even if they haven’t confirmed a commitment to serve in the position. The election will be rerun in coordination with the DOL to allow for this additional nomination option.
To be clear, DOL did not find any evidence of wrongdoing by any officer, representative, or candidate, and there was no instance of a member being prevented from nominating someone. While a rerun election is an extraordinary action related to the nomination procedural issue, there is no alternative remedy in DOL procedures. This is simply a procedural rerun of the election to ensure all active members in good standing are made aware of their full opportunity to participate in our democratic Union process.
We will be working with the DOL on next steps for a nomination and election process that will conclude by the end of July. We will communicate more in the coming weeks as we get all of the information about how to coordinate the election with DOL. In the meantime we are advised by DOL that candidates should refrain from campaigning until the election procedures are fully set and communicated to members of AFA-CWA Council 6.
